Terms of Service

GENERAL


By entering into this Agreement, you acknowledge that you have read, understood, and agreed to the terms set forth in this document, as well as any additional rules, policies, or service agreements established by Amazing Blu LLC.

Amazing Blu LLC provides a variety of services, including but not limited to weekly pool maintenance, repair services, and commercial pool services. Each of these services may be subject to specific terms and conditions, which you agree to review and accept when opting to use those services.

Additionally, should you choose to purchase any additional services beyond those outlined in this Agreement, you agree to review, accept, and adhere to any separate service agreements or terms and conditions associated with those services.

INTRODUCTION

1.1 By engaging the services of Amazing Blu LLC, the Customer agrees to the terms outlined in this Agreement. Amazing Blu LLC provides pool and/or spa maintenance services as detailed in this Agreement.

DEFINITIONS


2.1 "Company": Refers to Amazing Blu LLC.

2.2 "Services": Includes all pool and/or spa maintenance tasks provided by Amazing Blu LLC as described in the Service Checklist.

2.3 "Customer": Refers to the individual or entity receiving the services from Amazing Blu LLC.

2.4 "Agreement": This document outlining the terms and conditions of the pool service.

SCOPE OF SERVICES


3.1 Company agrees to provide the following services:

3.1.1 Water tested & balanced

3.1.2 Cleaning baskets

3.1.3 Brushing steps & walls

3.1.4 Skimming debris

3.1.5 Equipment inspection

3.1.6 Filter backwash

3.1.7 Vacuum service as needed

3.2 Services will be provided on a [weekly/bi-weekly/monthly] basis as agreed upon by the Parties.

3.3 Exclusions: This Agreement does not cover:

3.3.1 Structural repairs to the pool or spa, including but not limited to cracks, leaks, or damage to the pool or spa shell.

3.3.2 Equipment replacement, including pumps, filters, heaters, or other mechanical or electrical components.

3.3.3 Pool cover maintenance, including removal and reinstallation.

3.3.4 Additional services not listed in the Service Checklist, which will be billed separately.

3.3.5 Damage caused by third parties, including but not limited to guests, pets, or other service providers.

3.4 Additional Services: Any services not included in the checklist or requiring customization will be subject to separate agreements and fees.

CUSTOMER RESPONSIBILITES


4.1 Customer shall ensure access to the service location and that the pool or spa is accessible and uncovered.

4.2 Customer shall perform any preparatory work needed before service, such as removing pool covers.

4.3 Customer agrees to promptly notify Company of any pool-related issues or damages.

FEES AND PAYMENT TERMS


5.1 Cost of Services: Customer agrees to pay [Rate] on a monthly basis. Chemicals are [included/charged additionally].

5.2 Automatic Billing: Payments will be automatically billed to the credit card on file. By providing credit card information, Customer authorizes Company to charge the card for services rendered under this Agreement.

5.3 Payment Schedule: Payments are due within [Number] days of the invoice date. Automatic billing will occur on a recurring monthly basis.

5.4 Late Payment: Payments not received within [14] days may incur a late fee. Failure to pay within [14] days will result in termination of services.

5.5 Refund Policies: Company offers a money-back guarantee. If dissatisfied, Customer may request a refund as detailed in the Service Guarantee section.

TERM AND TERMINATION


6.1 Term: This Agreement is effective from the date of signing and will continue on a [monthly/annual] basis.

6.2 Termination: Either party may terminate the Agreement with [30] days’ written notice. Immediate termination may occur for non-payment or breach of terms.

6.3 Early Termination: Penalties or conditions for early termination, if applicable, will be specified.

LIABILITY AND DISCLAIMER


7.1 Company’s liability is limited to the services provided.

7.2 Company is not liable for damages from pre-existing issues or Customer negligence.

7.3 Company is not responsible for damages caused by third parties.

SERVICE GUARANTEE


8.1 Company strives for customer satisfaction. Details on making a claim if dissatisfied with the service are provided.

8.2 The Company’s commitment to quality includes a money-back guarantee, where applicable.

SKIP WEEKS & INCLEMENT WEATHER


9.1 In the event of inclement weather on the scheduled date of service, the pool and/or spa will be cleaned and serviced to the extent weather permits.

9.2 Circumstances such as severe weather, illness, or holidays may prevent Company from performing service. In such cases, service may be postponed for up to one week, not to exceed [5] postponements per year.

9.3 No pool and spa services will be provided during the weeks of Thanksgiving and Christmas.

FORCE MAJEURE


10.1 Company is excused from performing services due to events beyond its control, such as natural disasters, extreme weather, or pandemics.

DISPUTE RESOLUTION


11.1 Method: Disputes will be resolved through [mediation/arbitration].

11.2 Governing Law: This Agreement is governed by the laws of the State of [Your State], and disputes will be resolved in [Your County].

INDEMNIFICATION


12.1 Customer agrees to indemnify Company against any claims, damages, or losses arising from Customer’s actions or inactions.

CONFIDENTIALITY AND PRIVACY


13.1 Customer information will be used solely for service purposes. By signing this Agreement, Customer consents to the collection and storage of their data by Company.

AUTHORIZATION AND ADDITIONAL COST SERVICES


14.1 Company will make every reasonable effort to maintain the pool in a safe and healthy manner. However, the following services are not included in regular maintenance and may incur additional costs:

14.1.1 Chemical Adjustments for Water Loss: Extra chemicals needed due to unaddressed water leaks or other significant water loss events.

14.1.2 Specialized Algae Treatments: Treatments for persistent or severe algae issues, including black algae or other hard-to-control varieties.

14.1.3 Water Balancing for Extreme Conditions: Draining and refilling pools to manage high Total Dissolved Solids (TDS) or other extreme water conditions.

14.1.4 Post-Storm or Special Cleaning Services: Cleanings required after storms, heavy winds, or other unusual events that result in excessive debris or contamination.

14.1.5 Excessive Water Management: Draining or adjusting water levels significantly due to malfunctioning overflow systems or unusually high water levels.

14.1.6 High Bather Load Adjustments: Additional visits or chemical adjustments needed due to unusually high usage, such as large gatherings or events.

14.1.7 Post-Landscaping or Construction Cleanup: Extra cleanings needed after landscaping, construction, or other work that introduces debris or contaminants into the pool.

14.1.8 Post-Resurfacing Start-Up: Specialized procedures and chemical treatments required after pool resurfacing or renovation.

14.1.9 Advanced Chemical Treatments: Use of additional or specialized chemicals, such as algaecides, coagulants, flocculants, or metal sequestering agents, to maintain water clarity and balance.

14.1.10 Extended Cleaning Due to Equipment Failure: Additional cleanings required due to equipment malfunctions, repairs, or replacements that impact the regular maintenance schedule.

14.1.11 Permit Processing for Equipment Changes: Administrative fees for obtaining necessary permits for equipment upgrades or replacements.

ENTIRE AGREEMENT AND SEVERABILITY


15.1 This Agreement constitutes the entire understanding between the Parties. If any part is invalid, the remainder will remain in effect.

ACCEPTANCE OF TERMS


16.1 By using or continuing to use Company’s services, Customer agrees to all terms outlined in this Agreement.
